Fundamental Rights and Duties of the Residents

At the end of the lessons, students should be able to :

1. describe the major rights and freedoms of the residents of

the HKSAR as provided by the Basic Law;

2. identify the major duties of the HKSAR residents; and

3. apply the understanding of the rights and duties of the HKSAR residents as provided in the Basic Law to daily

situations.

I. RIGHTS OF HKSAR RESIDENTS

The rights and freedoms enjoyed by HK residents shall not be restricted unless as prescribed by law. Such restrictions shall not contravene the provisions of:

(a) the International Covenant on Civil and Political

Rights,

(b) the International Covenant on Economic, Social and

Cultural Rights, and

(c) international labour conventions

as applied to Hong Kong.

(1) Civil rights

[Article 39]

(a) All HK residents shall be equal before the law.

[Article 25]

(b) Hong Kong residents shall have freedom of speech, of

the press and of publication; freedom of association, of assembly, of procession and of demonstration. [Article 27]

(c) The freedom of the person of Hong Kong residents shall be inviolable. No Hong Kong resident shall be subjected
