requiring registration of all associations between local firms and foreign law firms which practise law in Hong Kong;
requiring in relation to a registered association that the 1:1 ratio rule of registered foreign lawyers to Hong Kong solicitors should apply to the local firm and the foreign law firm(s) in the association, taken together; and
prescribing requirements for the name or style of
any association.
Apart from these controls, the individual registered foreign lawyers in any of the associated firms would continue to be bound by the personal restrictions in paragraph C2 above.
The Committee proposes that:-
a local law firm should be allowed to form an
association
law firms;
with one or more registered foreign
a local law firm should also be allowed to form an with one or more unregistered foreign
association
law firms;
a
registered foreign law firm should normally be allowed to form an association with only one local law firm.
In
each case, any form of association would be permitted, subject to compliance with the Scheme.
