HONG KONG: LOCALISATION OF JUSTICE OF THE PEACE (JP) SYSTEM

1. I have no objection to the Hong Kong Government's proposal to make provision for the Governor to appoint Justices of the Peace under powers contained in local legislation. I agree that we will need to amend the Letters Patent, Article XIV. Please ask the Hong Kong Government whether they would be content with the deletion of

', Justice of the Peace'.

I would be most grateful for your comments and for the comments of Mr Stone to whom I am copying this minute as to whether we could combine the amendment to Article XVI of the Letters Patent (needed because of the Judicial Offices (Security of Tenure) Bill) with this amendment to Article XIV? The only objection I can see is one of timing. be that the timing of the two Hong Kong Bills will be rather far apart.

This would cause difficulties if our amendment to the Letters Patent combined amendments to both Articles XIV and XVI. Perhaps we could ask Hong Kong when they plan to localise the Justice of the Peace system.
