After receipt of this letter Mr. Broadley wrote again and his latest letter and the advice from our Crown Solicitor is attached. It appears that Mr. Broadely is no longer denying the power of the Crown to determine his service, but is now questioning whether the power has been properly exercised.

We have never before been challenged on a direction to retire in such circumstances under the LCS. We always inferred from the exchange of telegrams in 1986 that Secretary of State approved the LCS and delegated his power under Colonial Regulation 55 to determine a public officer's service when his retirement is required in the interest of localisation.
We wish to reply putting the matter beyond doubt. However before we do so it would be advisable to obtain your confirmation of the Secretary of State's approval and delegation. I should be grateful if this could be done as soon as possible.
