Authority for Retirement : Limited Compensation Scheme

Thank you for your letter of 30 September.

I have consulted Mr. Wingfield of Legal Department and we agree with your proposed course of action subject to slightly revised wording of the final ground for compulsory retirement as follows

"if circumstances exist, which in the opinion of the Governor, make it unreasonable or undesirable for the officer to continue in the Service".

It is advisable to use this wording to cover fully officers directed to retire on sensitive service grounds under the LCS and the Special Branch Compensation Scheme. The power to direct an officer to retire under the circumstances prescribed should be conferred on the Governor, with approval sought for the Governor to delegate this power to the chief Secretary and the Secretary for the Civil Service as you suggest.

I should be grateful if you would arrange for Colonial Regulations to be amended accordingly as quickly as possible.

In the case of Mr. Broadley we have decided, on legal advice, to give him a further eight months service. It is therefore important that we have the amended Colonial Regulation and power to delegate as soon as possible so that we can formally give hin six months' notice.
