1. Miss Sutherland's minute of 18 August to Mr Beamish argues

that, although we are to tell Hong Kong HMOCS officers that

their applications for posts in other Dependent Territories

will be considered on an equal basis with applications from DS

officers, in fact the Administration will give preference to DS applications. This seems to me undesirably disingenuous, particularly given the possibility of judicial review of our

treatment of HMOCS officers.

Miss Sutherland refers to Ministers' decisions about the

future staffing of the Dependent Territories, notably the decision to build up a cadre of DS officers with DT expertise.

However I understand that Ministers took those decisions

without the benefit of advice about the implications for our

obligations towards HMOCS, or indeed about the possibility of our exploiting some of the expertise available in Hong Kong to

promote the Government's objectives in the other DTs.

I think we should put these issues to Ministers before we

say anything further to the HMOCS Association in Hong Kong.
