HONG KONG: OFFICERS ON EXPATRIATE PENSIONABLE TERMS WHO ARE

NOT MEMBERS OF HM OVERSEAS CIVIL SERVICE (HMOCS)

Problem

1.

Certain expatriate pensionable officers, who are not

members of HMOCS, may try to use precedent and history to

argue that they should be included in any sterling safeguard which HMG may provide.

Recommendation

2.

That we should maintain our policy line that any

arrangements to protect the value of pensions beyond those in

the Joint Declaration (JD) are for members of HMOCS only.

Background

3.

In the course of our discussions preparing for the

next round of the Whitehall battle to provide a sterling

safeguard for the pensions of Hong Kong HMOCS officers,

our Legal Consultant has pointed out that the earlier

practice was to require a former colony to enter into a Public

Officers Agreement (POA) on independence whereby certain

officers, in addition to members of HMOCS, were entitled to

receive their pensions outside the former colony and, in such
