1. Thank you for your letter of 20′ May and the attached minute from Mr Suttill. First I should say that we entirely agree with you that this would not be an appropriate matter to raise with the Minister of State. But we do wish to deal with it quickly.
2. We do not have enough material available in which to form a basis for taking a decision on this matter. I therefore need your assistance in a number of areas:
(a) The Civil Service Regulations which we have do not/not apparently deal with Judges and Judicial Officers. We wonder whether this is because we have the 1990 edition, and administration of the Judiciary was devolved to the Supreme Court in 1990. Did the regulations pre-1990 include references to Judges etc? CSR 118 provides for the membership of HMOCS in straight forward terms. Was there an equivalent to CSR 118 in any regulations produced for the Judiciary?
(b) I should be grateful if you would send us the regulations currently applicable to Judicial Officers (Supreme Court, District Court and other Judicial Officers) specifically covering terms and conditions of appointment:
(i) to the pensionable establishment;
(ii) on agreement;
(iii) on transfer for (ii) to (i).
(c) Please send me the relevant circulars, if any, regarding modifications to regulations on Judges and other Judicial Officers with regard to:
(i) applications for permanent and pensionable establishment (ii) applications for agreement service
(iii) on transfer from (ii) to (i).
