Please advise Messrs Stewart-Pearson and Meredith case they choose their transfer to take effect from a future date, their applications will only be recommended to the Secretary of State for approval when they are within 6 months of the effective date of transfer.

It should also be explained to Messrs Stewart-Pearson and Meredith that upon transfer to the permanent establishment, their position will be as follows

As both Mr Stewart-Pearson and Mr Meredith were appointed after the
the age of 50, they will need to have not less than 5 years of continuous service (including their service on agreement terms) to qualify for an annual pension. If they retire from the service before completing the qualifying service, they will only be eligible for a short service gratuity.
The amount of pension benefits payable would depend on the length of their pensionable service, i.e. service completed after the transfer to permanent establishment plus any previous service bought back (paragraph 1(c) above).
(c) They will be required to contribute to the "Widows' and Children's Pensions Scheme" (WCPS) with effect from the date of transfer. If they opt to buy back past service for civil pension purposes by repayment of contract gratuity, they may also elect to pay WCPS contributions from either 1.1.78 or the date their pensionable service commences, whichever is the later.
A copy each of the following documents are also attached for the two Magistrates' reference -
(a) Conditions governing the Refund of contract
gratuities; and
(b) Special Regulations of Her Majesty's Overseas
Civil Service.

Please also provide me with a copy of their leave statement in respect of their current agreements, so that I may advise them on any leave and passage implications.
