Leave earning rate

A judicial officer who opts to transfer to 100% pensionability will have the leave earning rate adjusted with effect from the material date. The detailed arrangements are set out in Annex B(i).

As an option to transfer to 100%

100% pensionability would entail a consequential reduction in vacation leave earning rate, a transitional arrangement for officers currently on 90% pensionability will be required. An officer on 90% pensionability who applies to take leave in excess of what he would have earned had he opted to transfer to 100% pensionability will be required to undertake to

pay to the Government a sum equivalent to the salary of any future debit leave balance accrued at the time of his departure from the service should he eventually opt to transfer to 100% pensionability (Annex B (ii) is a specimen undertaking).

Leave record for judicial officers on 90% pensionability

The Judiciary will keep a record of the casual and vacation leave balance of those judicial officers on 90% pensionability showing the balance as at 1 April 1987.

Contributions to the Widows and Orphans Pension Scheme (WOPS) or the Widows' and Children's Pensions Scheme (WCPS)

For a judicial officer who opts to transfer to 100% pensionability, if he is a contributor to the WOPS and has not fixed his monthly contributions at $125 or above, he will have to contribute at 4% of

of 100% (and not 90%) of his emoluments

as from the material date. If he is a WCPS contributor, the rate of his monthly contribution will have to be adjusted on the basis of 100% (and not 90%) of his emoluments as from the material date.
