officers on 90% pensionability may, upon joining the NPS (JO), apply to transfer to 100% pensionability with effect from a material date (see Annex B) with a reduction of vacation leave earning rate.

The New Pension Scheme for Judicial Officers does not affect the level of benefits payable under the Widows' and Children's Pensions Scheme (WCPS) and the Widows and Orphans Pension Scheme (WOPS). It should however be noted that married members of WCPS
of WCPS leaving the service with an eligibility for pension (whether or not deferred) will not qualify for refund of past contributions. Married judicial officers who are members of WCPS and who resign
resign with
with an entitlement to a deferred pension under the NPS (JO) will not be refunded his WCPS contributions. Their dependants will however continue to enjoy coverage under the WCPS.
APPLICATION TO JOIN THE NEW SCHEME
I. Option period

Officers may, within the period specified below, apply to join the NPS (JO) and to have all their service attracting pension under the Pensions Ordinance (Cap 89) to be taken into account as pensionable service under the Pension Benefits (Judicial Officer) Ordinance 1988 -
(a) for a serving pensionable officer below the age of 50 on 23 December 1988, 5 years as from that date, or until his 50th birthday, whichever is the earlier, subject to a minimum of 2 years;
(b) for а serving pensionable officer over the age of 50 оп 23 December 1988, 2 years from that date or until his retirement age or expiry of current extension of service, whichever is the earlier;
(c) for a serving agreement officer appointed prior to 1 July 1987 who is allowed to transfer to pensionable terms, 6 months from the date of transfer to the pension- able establishment, or the period as in (a) or (b) above, as the case may be, whichever is the later (see paragraph 15); and
