iransfer of Agreement officers
to the Permanent Establishment
This circuler announces a new criterion to be adopted in considering applications from agreement officers for transfer to the permanent estaolishment and a time limit for them to exercise the option to augment their pensionable service.

Officers employed on agreement terms may apply for transfer to the permanent establishment. Upon approval of their applications, the officers may exercise their option to augment their pensionable service by repaying Government the contract gre tuities they have received, plus interest, in respect of their previous agreement service. Saic will have the effect that their pensionable service can be treated as having commenced on the date the agreement service started.

As a result of a recent audit review on the arrangements for transfer to the permanent establishment, the following additional criterion has been agreed with the Director of Audit to take wita effect from 1 January 1992. An application will only be considered 1f, after the effective uate of transfer (the earliest affective Cate being the cate be passes the medical examination),
examination), the officer will have a minimum of five years of service before he retires. This five-your reculrement can be relaxed to two years in the case of an officer who joined the Judiciary after the age of 50, or was appointed Deiore 1 July 1907 and has attained the age of 50 at the time of application.

Bu office: will be given a time limit of 12 months from the date of transfer to exercise his option to augment was pensionable service through refund of contract gratuitios plus interest. Ine option must be accompanist wy refund of the contract gratultios, which can be made by one of the following methods

one lump sum payment;
equal monthly instalments involving monthly deductions Flued at 25% of the officer's salary as at the date of commencement of such deductions;
repayment of a substantial amount initially, followed by method (ii) on the balance outstanding,
for officers une are 53 years of age or above, lump sum payment not later than 10 days before they commence caking pre-retirement leave. However, if an officer chooses this method of repayment but unfortunately passes away before repayment, he is not considered to have aucmented his pensionable service.
