Terms of Employment of Judicial Officers

I refer to CSB Circular No. 6/85 dated 28.3.85 on the subject of Terms of Employment of Overseas Officers, which states that overseas officers will in future be appointed to the Civil Service on contract terms only. It is the view of the Judiciary that this is not so with Judicial Officers and it is proposed that the Judiciary will continue to appoint them in future, whether overseas or local, on an initial probationary contract, thereafter with the option to transfer to the permanent and pensionable establishment. Indeed the transfer to the permanent and pensionable establishment is the only way in which a Judicial Officer who is not a Judge can obtain security of tenure.

For the avoidance of doubt, I should be grateful for your confirmation, as a matter of urgency, that the contents of the CSB Circular, consequent upon the enactment of the Pension Benefits (Judicial Officers) Ordinance, do not apply to Judicial Officers and that we are not able to prescribe any deadline for an application to transfer to the permanent and pensionable establishment.
