HMOCS : ELIGIBILITY OF JUDICIAL OFFICERS

Thank you for your letter of 27 May.

The

relevant regulations and instructions on referral to the Secretary of State which also govern the appointment of Judges and other judicial officers are attached for your reference

(a) Copy of CSR 103 (Annex A).

(b) Memo from P(C) dated 21.6.91 (Annex B).

The appointment

of Judges on pensionable terms, on agreement terms and on transfer from agreement to pensionable terms required the Secretary of State's approval up to 31 May 1991. Since 1 June 1991 only the appointment of the Chief Justice and High Court Judges requires the Secretary of State's approval.

The appointment of Judicial Officers other than judges, on pensionable terms and agreement terms is approved by the Secretary for the Civil Service and no referral is made to the Secretary of State. However, the transfers of other judicial officers to pensionable terms were approved by the Secretary of State up to 31 May 1991; but this had been stopped since 1 June 1991.

I also attach for your reference a copy of my memorandum dated 21.2.89 (Annex C) granting exemption for Judicial Officers from the deadline for application for transfer to permanent and pensionable establishment.
