The answer is we cannot prove that they did, and some may genuinely not have done. As far as we can establish,
HMG never issued any specific statement stating that
officers appointed to the Hong Kong Government after 28
March 1985 would not be eligible to become members of HMOCS.
We based our actions on the existence of the Hong Kong
Government circular of 28 March 1985, which was intended to
preclude any Hong Kong Government officers on contract from
becoming pensionable, and hence would preclude them becoming
eligible to apply for membership of HMOCS, if they started
work with the Government after that date.
3. We knew of the Hong Kong Government's intention to
change the conditions of service for judicial officers so as
