to HMOCS after they have reached retiring age, it would be open to the Secretary of State to refuse this application on the grounds that the applicants are past normal retiring age.
5. In the statement which I drafted for closing applications for HMOCS, which was attached to the submission of 30th June on Judicial Officers, we were careful to say that "applications...will continue to be received from otherwise eligible members of the Judiciary..". If the Secretary of State is minded to refuse applications from persons over retiring age, it would be prudent to replace the begining of this sentence as follows:
"In these circumstances, he has decided that consideration will continue to be given to applications for membership of HMOCS by otherwise eligible members of the Judiciary who have not reached normal retiring age if they were first appointed...
