HMG's commitment to keep the interests of HMOCS officers in

mind. Virtually all of our correspondence has been about (and with) HMOCS officers. (We may need to check past

coerespondence to resolve this definitively.) Would overseas P & P officers, who are not HMOCS, really be able to argue that they have a legitimate expectation for pension

protection?

With regard to non- HMOCS overseas P&P officers and SPOS, I believe that Mr Fish has stated that the legislation makes no differentiation between HMOCS officers and other overseas officers. This could weaken an argument for drawing a difference in the case of any sterling safeguard.

8. On stomach for the fight, looking down the list of officers involved, I doubt they would form a very cohesive and high-powered lobbying group. Some of them are spouses of HMOCS officers which could cause us difficulties.

L. I suggest that we should take further advice from Mr Fifoot on his return and from Mr Fish on his return, before we pursue further the question of what to do with over-age judges.
