Death of an Entitled. Officci
9. (1) Where an entitled, officer, dies on or after the operative date and compensation for loss of career has not been paid to him, there shall be paid to the legal personal representative of such officer or such of his dependants as the Governor or a Secretary of State may think fit a sum equal to the compensation for loss of career for which such officer would have been eligible if he had retired at the date of his death; and any such payment shall be in addition to such benefit as may accrue to the legal personal representative or dependants of deceased officer under the Pensions Law.
(2) Any sum or part thereof passing by virtue of this paragraph the death of a deceased entitled officer to any widow of the deceased or to any child of the deceased including any child, adopted by the deceased under any law governing the adoption of children shall be sins frinen antara Autir imenced hy the Fstate Duty Law or other law for the time being in force relating to the imposition of estate duty....“
Compulsory Retirement
10.-(1) Notwithstanding anything herein contained, the Governor may, when be considers it appropriate, require an entitled officer to retire on the basis of the abolition of his office or for the purposes of facilitating improvements in the organisation of the Department to which he belongs by which greater efficiency or economy may be effected.
(2) Any entitled officer retired in pursuance of sub-paragraph (1) of this paragraph shall be entitled to such pension, gratuity, and other pay- ments as he would have been entitled to if he had retired in accordânce with paragraph 2:
Provided that he shall not be granted any addition to the pension or gratuity for which he may be eligible by virtue of his having been required · to retire in pursuance of sub-paragraph (1) of this paragraph.
The Pensions Law
11.—(1) Section 10 of the Pensions Law shall not apply to any pension granted under the provisions of this Scheme.
(2) Save as is otherwise provided in this Scheme the Pensions Law shall apply in relation to the grant of pensions and gratuities granted in pursuance of this Scheme and the provisions of this Scheme shall be construed as one with the provisions of that Law.
(3) Section 4 of the Pensions Law shall apply in relation to any sum of money granted in pursuance of this Scheme, not being a pension or gratuity, as, by virtue of sub-paragraph (2) of this paragraph, it applies to a pension or gratuity so granted.
Income Tax
12. There shall be exempt from Income Tax imposed by the Income Tax Law, 1959, or any other written Law for the time being in force relating to the taxation of incomes-
(a) any gratuity granted under the provisions of sub-paragraphs (3) and
(4) of paragraph 3;
(b) any compensation for loss of career;
(c) any compensation granted under the provisions of paragraph 5;
(d) any payment made under the provisions of paragraph 9;
(e) any gratuity granted under the Pensions Law; and
(f) any disturbance grant.
