Our Legal Consultant has advised that previous schemes in other territories going to independence did allow for such service to count, although its incidence was likely to have been small. Precedent therefore would point to allowing such and the ODAS SPOS regulations do not make any unt distinction, -But we have been careful to present the scheme we are now promulgating Is unique and tailored to meet HK's circumstances. We could if we wished exclude such service.

The case for and against such action (has been considered in great detail in Mr Ricketts minute to Mr Hum of 29 June 1992 ref 431 in HKA 233/1. Mr Ricketts may feel that we do not need to put this point to Ministers, though given that we now have only, say, 4 to 4 and a half years until 1997, the issue becomes starker and as Mr Ricketts notes in his manuscript minute,j we mentioned this issue in passing to HMT in para 11 of AnnexC of the S of S letter to the Chief Secretary dared 11/2/92 and Coxs letter to Mountfield of 30/8/91. This was in the context that the cost would depend on how many bought back service and how much not that we could influence it.

Although we have stopped any more HK officers from being eligible to apply for HMOCS, we have not yet set a deadline for them actually to apply. We could not do this in practice until HK decided which officers were successful in their applications for transfer to pensionable status. (This is a feeble excuse for a cock up by the way.) HK now consider that they will be able to complete the exercise by
