Certain expatriate pensionable officers, who are not members of HMOCS,
may try to use precedent and history to argue that they should be included in any sterling safeguard which HMG may implement.
Recommendation

That we should maintain our policy line that any arrangements to protect the value of pensions beyond those in the Joint Declaration
(JD) are for members of HMOCS only.
Background
Our Legal Consultant has pointed out that in previous colonies moving
to independence, provision was made in Public Officers Agreements
(POAS) for certain officers, in addition to HMOCS officers, who had a
right to receive their pensions outside the country to be eligible to
receive such in a manner which safeguarded the sterling value. These
officers normally had to have been appointed on overseas terms, to the pensionable establishment, and to a post where a normal channel of recruited or appointed was by the the Secretary of State or through the Crown Agents or a body recognised as similar by HMG.

We have now established with the HKG that there are some 57 serving officers in a similar appointment category in Hong Kong. There are also about 270 retired Indian and Pakistani officers (living in the
Sub-continent) who may be
able to claim such a status- but we doubt they know of its existence.
