Analysis of our Proposal

We have set out some special factors of which we have taken account in drawing up the proposed scheme, but I do not think it fruitful to try to discuss exactly what relative weight has been given to each of these and to the other considerations: we have to make an overall political judgement of what in all the circumstances would be fair and reasonable: having regard to HMG's responsibilities both towards HMOCS officers and towards Hong Kong interests generally: not a mathematical exercise.

2. We consider that our proposed scheme will offer members of HMOCS a reasonable measure of compensation for the fact that on 1 July 1997 they will cease to be members of HMOCS and for all the associated implications and uncertainties, against the background of Hong Kong's special circumstances and notably of the Joint Declaration's provisions for continuity, which mean that former HMOCS officers will not be left unprotected for after 30 June 1997. It includes an element of compensation for possible impairment of career
prospects.
3. We think it would be unrealistic and misleading to suggest that any substantive special relationship between the Secretary of State and HMOCS officers can continue after 30 June 1997. In the Hong Kong context it will not be possible to regard HMOCS officers who continue to serve in Hong Kong as being in Her Majesty's Service: they will serve in their individual capacities.
