HMOCS or

(b) either became members of Her Majesty's Overseas Judiciary (HMOJ) on or before 30th June 1992 or were individually informed on or before 30th June 1992 by or on behalf of the Secretary of State that they would be treated in the same manner as a member of IIMOCS,

other than judges referred to in paragraph 6 below, will also be cligible as entitled officers for benefits under and in accordance with the Scheme.

Members of HMOCS and judges to whom paragraph 4(b) refers who on 30th June 1997 are seconded for service

outside Hong Kong or to a non-Government organisation within Hong Kong will be treated in the same way as other entitled officers.

OFFICERS NOT ELIGIBLE FOR BENEFITS UNDER THE SCHEME

6.

The following categories of officers and judges are not eligible for benefits under the Scheme:

i) officers and judges who have reached normal retiring age on or before 30th June 1997;

ii) officers and judges on leave pending retirement on 30th June 1997;

iii) officers seconded or temporily transferred to Hong Kong;

iv) officers who have received any

benefit under the Compensation Scheme for Certain Pensionable Officers promulgated by the Government of Hong Kong and published as an Annex to Civil Service Branch Circular No. 24/87 of 9th December 1987.

CALCULATION FOR BENEFITS PAYABLE UNDER THE SCHEME

7.(1) A calculation will be made of a notional maximum sum for which each entitled officer would be eligible under the Scheme using the factors appropriate to the age and pensionable service of the officer in the relevant Table.

(2) The relevant Table:

(a) for officers to whom the Pensions Ordinance applies, is Table I;

(b) for officers to whom the Pension Benefits Ordinance applies, is Table II; (c) for judges whose normal retiring age is 65, is Table III;

(d) for judges whose normal retiring age is 60, is Table IV.

(3) The notional maximum sum would be calculated as follows:

(a) identify the entitled officer's salary point for the substantive grade held by him on 30th June 1997 and then determine the salary appropriate to that salary point of that grade at 1st January 1992. ("the notional 1992.
