THE TRINIDAD AND TOBAGO (CONSTITUTION) (AMENDMENT) ORDER IN COUNCIL, 1959

THE TRINIDAD AND TOBAGO (CONSTITUTION) (RETIREMENT OF ENTITLED OFFICERS) REGULATIONS, 1960

IN exercise of the powers conferred upon the Governor by section 20 of the Trinidad and Tobago (Constitution) (Amendment) Order in Council, 1959, the following Regulations are hereby made with the concurrence of the Secretary of State: -

1. These Regulations may be cited as the Trinidad and Tobago (Constitution) (Retirement of Entitled Officers) Regulations, 1960, and shall come into operation on the 25th day of November, 1960.

2. (1) In these Regulations unless the context otherwise requires

"appropriate law" means, in relation to any officer, the law for the time being in force governing the grant of pensions, gratuities and other like benefits to or in respect of such officer;

"entitled officer' means an officer who immediately before the 1st day of December, 1960, was the substantive holder of a pensionable office in the public service of the Government of Trinidad and Tobago, being a person-

(a) who was selected for or offered appointment to an office in such

public service by a Secretary of State; or

(b) whose appointment to any such office was approved by a

Secretary of State; or

(c) who had entered into an agreement with the Crown Agents for Oversea Governments and Administrations to serve in any such office; or

(d) who (although he is not a person falling within paragraph (a), (b), or (c) of this definition) is or has been a member of Her Majesty's Overseas Civil Service or Her Majesty's Overseas Judiciary or has been a member of a former Colonial Unified Service;

"pension" includes reduced pension and gratuity;

"pensionable age" means. in relation to a Judge of the Supreme Court, the age of 60 years, and in relation to any other officer, the age of 57 years;

"retire" with its grammatical variations and cognate expressions means retire under these Regulations;

"substantive holder" in relation to any office includes a person serving in that office on probation but does not include a person (other than a person serving under a probationary agreement) serving in that office for a specified term under a contract.
