HONG KONG: DELEGATION OF POWERS UNDER COLONIAL REGULATIONS
(CRS)
Problem
1.
The Hong Kong Government are seeking the Secretary of
State's approval under the Colonial Regulations for the
delegation of some of the Governor's powers in relation to
disciplinary procedures.
Recommendation
That, under CR 54 (5), the Secretary of State approve that the Governor may delegate:

(a) to the Secretary for the Civil Service the authority of
dismissal under CR 57 and 58 in respect of officers
confirmed in an established post remunerated below point 14
on the Master Pay Scale; and
(b) to heads of departments personally the authority
summarily to dismiss under CR 57 (3) category A officers
remunerated below MPS point 14.
The departmental Legal Adviser is content. We are advised
that these changes need to be approved by the Secretary of
State.
