I refer to your letter of 19 November about the
Lorrain Osman case.
The views which I expressed in my letter to you of 30 April are still valid, and I have little to add. The confidential telegram which has come into your possession is, as I said, a privileged document, not withstanding the fact that a copy was passed to you. Nor is the privileged nature of the document changed if, as you now claim, a copy was passed to you at the European Parliament. The degree of publication you allege is clearly insufficient to tip the balance according to the criterion stated by Lord Justice Mann, which you quote]
It accordingly remains our view that use which you propose to make of this document is improper, and I invite you again to reconsider most carefully before making any further use of it.
