LORD JUSTICE WOOLF: Mr. Lorrain Esme Osman has been detained in
prison in this country since 6th December 1985. At the
present time he is being detained in Brixton prison. He has
been remanded in custody to await his return to Hong Kong
pursuant to a request of the Government of Hong Kong, the
Chief Metropolitan Magistrate having made the appropriate
order on 1st June 1987. Over the succeeding years the
applicant has made six applications for habeas corpus ad
subjiciendum. I will refer to those applications as habeas
corpus 1 to 6 in accordance with their chronological order.
The respondents to the application are the Governor of Brixton
prison, who is the first respondent, and the Government of
Hong Kong, which is the second respondent.
There is a cross-application by the second respondent.
That cross-application seeks that the applicant be restrained
from arguing the grounds of this application unless he first
obtain the leave of the court and satisfies the court that
such an application is not an abuse of process and that there
are reasonable grounds for the application and that in the
event that no such application for leave is made or leave is
not granted, the application be dismissed.
The second respondent also seeks the following series of
directions:
"11.
that any further application be made by Originating Motion to a Divisional Court;
2. that such Notice of Motion be served on the Hong Kong Government upon its being filed with the Court;
