OSMAN : APPLICATION FOR DISCOVERY OF DOCUMENTS

1. At our meeting last Friday afternoon, we examined all the documents which had at that stage been extracted from our files and discussed which were relevant, and which class those documents could be said to fall within for the purposes of PII.

2. We discussed the difficulty identified by Mr Guy in his minute of 25 April 1990 of delimiting the scope of the phrase "dealing with the investigation, prosecution and/or the extradition of Mr Osman" which appears in paragraphs 2 and 3 of Schedule II to the Application for discovery. We decided that at this stage we should give the phrase a wide interpretation and include general references to the investigation process where Osman is not named and telegrams dealing with the answers to PQs where the subject matter (eg. length of proceedings) was raised by Osman in his present habeas corpus application. We decided to include in particular the correspondence about whether the publication of the Noordin Committee Report would prejudice forthcoming trials in Hong Kong.

3. I have now examined all the relevant files from our South-East Asian Department, Hong Kong Department and Nationality and Treaty Department. I have extracted the following documents:
