It will be well known to this Court that Mr TAN also faces charges concerning alleged conspiracies to defraud Bumiputra Malaysia Finance Limited and related charges alleging breaches by him of the Prevention of Bribery Ordinance. These proceedings were brought in December 1985 and have been delayed by reason of the absence from this jurisdiction of the alleged co-conspir one Lorrain Esme Osman, in respect of whom extradition proceedings have been undertaken in the United Kingdom.

The present charges before this Court (ie

those concerning Paul KIANG and West LB) were brought by the Attorney General at a time, when the Crown were advised that Osman proposed to exhaust all avenues of appeal in the United Kingdom and before the European Court of Human Rights and was unlikely to return to Hong Kong before November/December 1989.

CIRCUMSTANCES HAVE NOW CHANGED and we now anticipate Osman's return to Hong Kong within the next six months after which the BMFL case will be brought to trial as a matter of priority. Accordingly, after considering with great care written submissions made on Mr TAN's behalf and in the light of the recent advi as to the progress of the Osman proceedings, it seems to us that there is a risk, should the present charges before this Court be transferred to the District Court
