result that the evidence-gathering exercise in the U.S. will have
to start afresh on the basis of the correct procedure. I am
advised and verily believe that the same erroneous procedure had
been adopted by the Hong Kong government in the gathering of
evidence in California.

(3) Having decided that there should be a joint trial
Tan, Saniman and myself, the Hong Kong government
decided to proceed with a different trial ("the West LB trial")
recently fixed for 20th January 1992, which relates only to
before proceeding further with the BMFL case, the Hong Kong
government having admitted that no evidence gathering in Malaysia
for the BMFL trial is possible during the West LB trial or any
appeal in respect thereof.
French
conducted
the extradition
(4) The Hong Kong government
proceedings against Saniman in France in such a manner that the
courts declined in 1987 to order his extradition to Hong
Kong, whereupon the Hong Kong government had to re-commence
proceedings in 1990, with the result that no final decision
such

be made therein for at least another year from now. The latter
information recently reached my solicitors by a letter from
Saniman's French lawyers dated 16th July 1991.
These matters will be elaborated upon hereinbelow.
