I understand that you have had the pleasure of dealing from time to time with the above named resistance against extradition to Hong Kong. As you may well be aware Mr. Osman's recent application for Habeas Corpus was dismissed by the Divisional Court. I enclose herewith a copy of that Judgment. Mr. Osman has now followed up with another Habeas Corpus application, which I enclose herewith.
I have considered the matter with Clare Montgomery in conference together with Pat Edwards.
The new application raises the following main points:-
1. No speciality assurance has been sought from the Hong Kong authorities.
2. The Applicant could receive adverse treatment after 1997 from the Chinese authorities.
3. New facts have allegedly arisen in respect of missing documentation which I understand is the subject of further proceedings within Malaysia.
Whilst the view has been taken that this fresh application is largely abusive, nonetheless, it has been decided to tackle by way of affidavit the arguments relating to the post 1997 situation.
As you will see from the enclosed draft affidavit and the note from Clare Montgomery it is envisaged that the deponent should be a member of the FCO, perhaps either from your own Branch or perhaps from the China desk. I would be grateful if you would kindly consider this question as a matter of urgency and contact me thereafter.
