to their inclusion, the FCO Legal Adviser has suggested that the following footnote be added to the list to clarify the position:
"Where a holding company qualifies under one of the six categories, and the Committee is satisfied that the holding company has effective control of a group of companies, such companies have also been defined as British."
The Next Steps
As soon as Ministers have approved the list, it will be submitted to the Governor for approval. It is for consideration whether publication should be held over until the remaining difficult cases have been cleared up. The eventual publication of a single list would help to avoid focussing public attention on relatively controversial marginal companies. On the other hand, it is important that publication of the list is not delayed for too long; the deadline for applications is 28 February and the Hong Kong Government are coming under increasing pressure to publish a list so that applicants know where they stand.
