"TOO LIKE" NAMES

WHAT DO YOU MEAN BY "TOO LIKE”? When deciding whether the name of one company is "too like" that of another, the Secretary of State first

looks at the two names. Only if the names appear to

be like each other does the question arise whether

they are "too like", that is whether there is a danger of

confusion between the two companies.

If the names differ by one or more words, this may

suggest that they are not "too like", depending on, for

example, the word(s) in question and the length of the

names in question.

If it appears that the names could be "too like", the

Secretary of State then takes account of any factors

which suggest that there is a danger of confusion

between the two companies. Such factors may include

the nature and location of the companies' respective

business activities.

Evidence to show that confusion has arisen between

the two companies is also taken into account.

It is important to remember that consideration can only

be given to the full corporate names of the companies.
