4. Because there was, in Mr Fries's view,

time to consider the question and consult Home Office

Ministers before the Prime Minister's visit, he recommends a

holding reply. If we still think the case should be

considered further he thinks the best way to proceed might

be for Lord Caithness to refer the representations to

Mr Lloyd.

5. Mr Fries's arguments seem weak and bureaucratic: they

would carry no weight in Hong Kong, where OMELCO are

hoping for a more sympathetic and constructive response. But our experience is that Home Office Ministers tend to be resolute in resisting special pleading for Hong Kong.

They would like to draw the line at the 1990 Act, and I

judge they will take some persuading to concede in this

matter. Nevertheless, there is a respectable case to be

made and I think we should make it. If the Minister is

content to proceed in this way I shall submit a draft letter

to Mr Lloyd.
