BRITISH NATIONALITY ACT 1981: DR C H LEONG

Problem

A 1. How to reply to Dr Leong's letter of 20 August,

following up about the point he raised with the

Minister of State in Hong Kong last month.

Recommendation

2.

I recommend that Lord Caithness send an interim reply

assuring Dr Leong that the case is being considered in

consultation with the Home Office and I submit a draft

covering reply to Dr Leong.

Background and Argument

3. Lord Caithness is familiar with the background to this problem. At Lord Caithness's meeting with OMELCO members on

23 July in Hong Kong, Dr Leong raised what he described as

an "anomaly" of the BNA 1981. Lord Caithness asked for

detailed information so that he could follow up with the

Home Office. Dr Leong has now written to Lord Caithness

with the information, and urging that the Home Secretary

should use his powers under Section 3(1) of the Act to grant

full British citizenship to the affected children of British
