1. You asked for our view on the issues raised in the
article from the South China Morning Post. The situation
described in the article is not new nor unique to Hong Kong but has clearly aroused interest as a result of the Hong Kong Act 1990. It arises from the various provisions of the British Nationality Acts 1948 and 1981 and of the Immigration
Act 1971.
2. I attach an extract from our staff instructions which illustrates (for your information only) the way legislation
can have a different effect on children born either before or
after 1.1.83 (when the BNA 1981 came into force). No. 1 on
the extract is directly relevant to Hong Kong. In these circumstances any children born before 1.1.83 can apply for
registration as a British citizen.

There is no record of a formal approach having yet been
made to the Home Office nor are there details of the likely
number of children involved. In response to the newspaper or
to others expressing a similar interest, I suggest that you
