Mr Boyle arrived in Hong Kong from Indonesia

on 12 February 1991 at 1400 hours with his wife and two children. They were British citizens.

Mr Boyle stated that he was an artist and a film-producer while his wife a mental health doctor. The four of them had just visited Australia, Singapore, Thailand and Indonesia. They intended to spend 3 to 4 days in

Hong Kong before returning to United Kingdom.

In Mr Boyle's case, Immigration Department's record revealed that he was sentenced on 2 September 1967 at Glasgow High Court to life imprisonment for murder, with a recommendation that he should serve a minimum of 15 years.

The duty Senior Immigration Officer decided not to give Mr Boyle permission to land in view of his adverse record. He was explained that the decision was taken on immigration grounds, and that his wife and children could enter Hong Kong if they so wished.

Mr Boyle was not satisfied with the decision. He threatened to lodge a complaint with the Foreign & Commonwealth Office and hold a press meeting upon his return to the United Kingdom.

The case was therefore reviewed by a Chief Immigration Officer who decided to maintain the decision.

While arrangements were being made with the airline to remove Mr Boyle from Hong Kong, he was twice taken to the transit lounge where he made а number of long distance calls at 1700 hours and 1750 hours. His wife and children, who chose to stay with him, were also taken to the transit lounge at 1730 hours to have their meals.

The Foreign & Commonwealth Office subsequently contacted the Political Adviser's Office. Mr Boyle was said to have reformed and turned over a new leaf, and the Metropolitan Police criminal records in New Scotland Yard revealed that they had no recent or outstanding
