REFUSAL OR POSTPONEMENT OF ASSISTANCE

Assistance will be refused if the Central Authority of the Requested Side determines that execution of a request

would seriously impair the essential interests of the Requested Side.

9.

Assistance may be refused or postponed if execution

of a request could prejudice an investigation or proceedings being conducted within the Requested Side's jurisdiction or impose an excessive burden on the resources of that Side.

10.

Before refusing to grant a request for assistance the Central Authority of the Requested Side will consider whether assistance may be granted subject to such conditions as it deems necessary. If the Central Authority of the Requesting

FORM AND CONTENTS OF REQUESTS

the name of the competent authority conducting the investigation or proceedings to which the request

relates;

b) the purpose of the request, including a description of the evidence, information, or other assistance sought; and
