MUTUAL ASSISTANCE IN RELATION TO DRUG TRAFFICKING
1. You are aware of the mutual designation arrangements which Gibraltar entered into with the UK last year and of the current x negotiations on reaching agreement which will enable Gibraltar and Spain to have similar arrangements. We have now received a proposal from Hong Kong to enter into the same kind of mutual assistance agreement. I enclose copies of the Hong Kong
correspondence.
2. Although the Gibraltar Council will need to be consulted, in principle we would be
would be happy to conclude an agreement with Hong Kong and indeed you have already recognised (your letter to me of 11 September 1990) that we could contact other Dependent Territories direct on the subject. Now that there is a specific proposal however to make a mutual confiscation agreement between Hong Kong and Gibraltar could you please let me have guidance (consulting Legal Advisers necessary) on the form suggested by Hong Kong for an agreement. Adding Hong Kong to the list of designated territories provided for in the Drug Trafficking Offences Ordinance (Designated Countries and Territories) Order 1990 (copy also enclosed) is the way in which the agreement would be given effect in Gibraltar. I should also be grateful for advice on the status of what Hong Kong
Kong describes as "draft guidelines". I cannot see what precise status and effect they would have.
