HONG KONG/NETHERLANDS EXTRADITION AGREEMENT

Please refer to your minute of 15 May I apologise for the delay in replying: we have only just feceived our Legal Adviser's comments on the Dutch note.

To answer a point in the first paragraph of your minute, we have agreed with the Chinese in the Joint Liaison Group that Hong Kong may in principle enjoy separate extradition arrangements with other countries which can continue in force after 1997. We will be showing them the text of the Hong Kong/Netherlands treaty in due course to obtain their agreement that this particular agreement can continue in force after 1997.
3. Regarding the Dutch diplomatic note our Legal Advisers propose one change: the reference to "Hong Kong" in the second line of the fourth paragraph (of the draft Note faxed by the Dutch Ministry of Justice to Mr Angel at the Home Office on 8 May) should be replaced by the wording "the United Kingdom in respect of Hong Kong until it has been replaced by a new agreement as envisaged, ".
4. I hope that this will enable you to reply to
Mr Underwood's letter of 10 May. Subject to your agreement I will reply to Mr Schutte along the lines of the attached draft.
