CONFIDENTIAL
DIEU 1
It has since transpired, however, that you currently have that right under existing Hong Kong law (contrary to your earlier legal advice): paragraph 1 of Mr Hatcher's last letter makes this clear. I should be grateful to know therefore whether you are still in principle supportive of Hong Kong's proposed amendments given that you no longer have a reciprocal gain. Rather, the amendment would be making the prevailing situation more equal as between the Crown/UK's right to sue Hong Kong people and Hong Kong people's right to sue the Crown/UK.
5. If you are willing to proceed, perhaps you and your Legal Advisers could let me have any comments on Hong Kong's
draft amendment.
Yours
ever
