On 28 February the Cabinet approved the proposals made by FLG Committee for the preparation of next Session's programme, and agreed that the Committee should position in May and report further. The purpose of this letter is to pave the way for that review and report.
The basic approach which FLG took was to recommend a programme on the assumption that 1991-92 was a fifth Session, and to identify additional Bills more suitable for a
first Session on which preparatory work could be undertaken. I emphasised that all places in the programme must be regarded as highly provisional at this stage, and

in deciding whether Bills should maintain their places would be the progress made in clearing detailed policy proposals and submitting instructions to Parliamentary Counsel.
Fifth Session Bills
On the fifth Session Bills I am grateful to colleagues for the efforts they have made to meet the timetable for policy clearance and drafting which FLG set out. Several have already submitted instructions ahead of the May deadline and I would be grateful if those who have still to submit instructions would review and report to me on whether there is any prospect of accelerating the process.
FLG's review will not be reopening consideration of Bills which were not awarded provisional places, except for those specifically mentioned in the Cabinet discussion (the Hong Kong (Appeals) Bill and the Rents to Mortgages (Scotland) Bill). It is, indeed, more likely that the addition of new material on the lines envisaged by the Cabinet will limit the number of Bills in our original proposals which can be accommodated. To help the Committee in its recommendations I would find it helpful to have from you any comments you wish to make on your present view of the priority and political importance to be attached to your Bills which were awarded provisional fifth Session places.
