1. Lord Caithness has seen your submission of 5 April and agrees with the recommendation that the Hong Kong Government should amend its Immigration Ordinance as proposed, but that we should pursue the idea of a new independent body to review transfers in disciplinary cases. He has commented that the changes will not solve the problem of what to do in a year's time but they plug the gap in the best way possible for the time being. He believes that the possibility that during the freeze period the backlog of people waiting to be screened might be reduced or a mandatory repatriation scheme might be in place (paragraph 7 (a) and (b)) of the submission are both hopeful at best. He considers that our policy should be to have a maximum of two years detention before screening with appropriate resources made available by HKG to meet this target.
