So far, it has not been necessary to invoke special conciliation or refer any trade dispute to arbitration or a board of inquiry.

A trade union may participate in the conciliation of a trade dispute

if:-

(a)

it is a party to the trade dispute; or

(b)

its members are parties; or

(c)

all parties have no objection to its participation.

An office bearer of a registered trade union has the right of audience before an arbitration tribunal or a board of inquiry if the trade union or its member(s)

its member(s) is a party to the trade dispute.

The Labour Tribunal, which is part of the judiciary, complements the Labour Relations Service by providing a quick, inexpensive and informal method of settling certain types of disputes between employees and employers when conciliation fails.

134. Is corporal punishment consistent with the Covenant? (SR 161 Paragraph 43 and SR 162 Paragraphs 5, 54, 90 and 100)

The position regarding administration of corporal punishment is as set out in paragraphs 21 and 22 in Annex H of CCPR/C/1/Add.37 dated 15 November 1978. See also Mr Watts' answer at SR 164 Paragraphs 54 and 55.

135. The initial Hong Kong report states that an arrested person is "in general" informed of the true grounds for his arrest. What are the exceptions? (SR 162 Paragraph 7)

In all cases when a person is arrested by the police he is informed of the true grounds for his arrest. The expression "in general" was not meant to imply that there were exceptions.
