COMMISSION ON HUMAN RIGHTS: FRENCH DRAFT RESOLUTION ON ADMINISTRATIVE DETENTION WITHOUT CHARGE OR TRIAL

The French have come forward with an initiative at the Commission on Human Rights (CHR) to appoint either a working group or a special rapporteur on Administrative Detention. This resolution is being presented as a successor initiative taken by the UK in 1988 on political prisoners. This initiative failed, and thus the proposal on administrative detention is seen by some as its successor. However, the French proposal goes much wider in its scope. The Home Office have pointed out the potential relevance of this proposal to the Prevention of Terrorism Act, detentions without charge under the Police and Criminal Evidence Act, and see difficulties in the UK lending its support to this proposal. In addition, HKD may have views on this with regard to the detention of VBPS.
