4. The petitions are made by Mr Chan Chun-Shan and his family on behalf of his two sons Mr Chan Kan-Sau and
Mr Chan Kan-Cheung. Petitions have already been made to the
Governor by or on behalf of Mr Chan Kan-Sau in 1983, 1988
and 1989 and in the case of Mr Chan Kan-Cheung, in 1988 and
1989.

The Chan brothers are both Triad Society members. They
had been collecting debts with their Triad leader and this
lead to the brutal murder of a man in a restaurant in
December 1978. They had been collecting debts with their
Triad leader. The brothers were found guilty of murder and
sentenced to death in November 1979. Following unsuccessful appeals against conviction and sentence, their death sentences were commuted to the life imprisonment early in
1981. Both cases were reviewed by the Board of Review, Long
Term Prison Sentences in January 1990 but Board members
declined to make any recommendation. The cases will be
reviewed again in December 1991.

Mr Chan Chun-Shan's petitions ask for his two sons' release on the grounds that both are penitent and wish to serve society for their mistakes. Mr Chan Chun-Shan asks
that Chan Kan-Sau be released to look after him in his old
age. However, the reports of the Commissioner of Police and of the Commissioner of Correctional Services indicate that
there are no grounds to justify an early release of the prisoners. A report of the Probation Office on the welfare of the Chan family also concludes that there are no social grounds to substantiate the petition.
