The Petitioner MOK Kwong-yuen is a 25 year old single male from Canton, who came to Hong Kong illegally in 1977. His criminal

On 28.9.79 record shows three previous convictions for serious crime. he was convicted of murder. lie appealed, obtained a re-trial and was again convicted of murder on 3.4.80 He was sentenced to be detained pending Her Majesty's Pleasure.

Police Report

This was a case of Murder/Robbery which occurred on the morning of 3.2.78 at 3, Deep Water Bay Rd., G/F. resulting in the death of E/F Margaret Boycott.

The two culprits one of whom was OK Kwong-yuen planned a Robbery and purchased two meat knives at Wah Yu Estate. They then took a No. 41 bus to Deep Water Bay Road. They found the door of No. 3 on the ground floor flat was unlocked and pushed it open. They went in and began searching, when a European woman discovered them she started screaming. They grabbed her and a struggle took place. They stabbed her several times till she fell to the floor bleeding.

They then made a hasty search for loot, as they grabbed a few items the phone rang and one of them ripped the cord out of the wall.

On seeing that the situation was now serious they fled and buried the knives and loot on a nearby hillside. On being arrested they admitted the offences under caution. They also led police investicators to the hillside where the knives and stolen items were recovered.

Strong evidence was presented at the trial which led to the conviction of MOK Kwong-yuen and his accomplice.

Fetitioner's Grounds

i) He has spent more than six years in custody and

contends that a prisoner detained at Her Majesty's Pleasure would normally be given a determinate sentence within 3 or 4 years. He therefore asks for a determinate sentence.

ii) At the time he committed the crime he was a rash

young man of 17 and he was under the influence of others. He is now determined to turn over a new leaf, he states.
