(6) The operation of employment agencies in Hong Kong is regulated by the Employment Ordinance and the
Employment Agency Regulations, which stipulate strict rules for the licensing of and fee-charging by all agencies. The legislation is enforced by regular inspection, prompt investigation of complaints and prosecution of offenders. Agencies which are convicted
of offences may have their licenses revoked.
(7) The Hong Kong Government do not consider it
feasible to require employment agencies to contribute
funds for rendering financial assistance to foreign
domestic helpers whose contracts are terminated prematurely. An agency is not responsible for how the
employment contract works out for the contracting
parties. In any event, only about one-third of foreign
domestic helpers are hired through agencies.
