Problem
1.
An undated petition to Her Majesty the Queen from one
Mr Hung Kai-Ming, a superintendent in the Correctional Services Department in Hong Kong asking for the Queen's
consideration of disciplinary action taken against him by
the Hong Kong Government.
Recommendation
2.
I recommend that the petition be denied. This is the
advice of the Hong Kong Government. Our Legal Advisers
concur. I submit a draft departmental reply in accordance
with DSP Vol. 8, Chapter 9.4.1.
Background and Argument

In accordance with Colonial Regulations 169-171, the
Hong Kong Government have forwarded to us the attached
petition. It was received in Hong Kong Department on
29 October last year but Legal Advisers were initially
unable to consider it due to the inadequacy of the
information supplied by the Hong Kong Government. The
relevant information was received in mid January.

Mr Hung Kai-Ming is a superintendent in the Correctional Services Department in Hong Kong. In July 1989 as a result of a disciplinary enquiry, Mr Hung was awarded a severe
reprimand under Colonial Regulation 56 for misconduct. He
was found guilty of bringing "prejudice to the good order
and discipline within the correctional Services Department". Mr Hung had, amongst other things, disobeyed the instructions of his superior officer by bringing a tape recorder to two disciplinary interviews and then refusing to
