Multi-user land grants

Multi-user land grants, irrespective of whether by way of public auction, tender or private treaty, will be dealt with in accordance with the following principles :-
(a) The entire area of the land alienated to the
grantee will be regarded as new land granted
and accountable as such under paragraph 4 of
the Sino-British Joint
Annex
III to
(b)
Declaration.
The premium income received from such land
transactions will be shared equally between
the Hong Kong Government and the future
Special Administrative Region Government, after deduction of the average cost of land
production on the understanding that no part
of the premium income due to the future
Special Administrative Region Government is
used indirectly to defray the cost of
construction of the required Government,
Institution and Community/Open Space (GIC/OS)
facilities.

The two sides noted that it is the Hong Kong
Government's normal practice to reimburse the construction
costs of new GIC/OS
facilities to the developer
concerned.
The Land Commission will be informed of any
exceptions to this practice beforehand.
