Agreed Minute No. 26
At the
twenty-first meeting of the Sino-British
Land Commission held on 5 December 1990, the British and Chinese side agreed on the following points :-
Special Purpose Leases involving a change of user

In the light of paragraph 3 of Agreed Minute
special purpose involving a change of with in accordance with the following
No. 10, leases for
user will be dealt
principles :-
(a) Where the extension and/or modification of a
special purpose lease with a change of user
does not result in the lease becoming an
ordinary lease, and provided that the
original user and modified user do not fall
under paragraph 3(b) and (g) of Agreed Minute
No. 10, the extension/modification
will be
reported
by way of the regular quarterly reports on variations to the list of special purpose
with details to the Land Commission
leases.
(b)

Where the extension and/or modification of a
special purpose lease with a change of user will result in the lease becoming an ordinary lease, or where the original user or modified
user falls under paragraph 3(b) to (g) of
Agreed Minute No. 10, the case will be
to the Land Commission for
consideration, except as otherwise agreed (as
in the case of civil service co-operative housing and workers' quarters leases, where
the modifications will be reported to the
Land Commission by way of the regular
quarterly reports on variations to the list
of special purpose leases).
